As you may already know, the Interim Final Rule “10+2”, Importer Security Filing and Additional Carrier Requirements” was published on November 25th, 2008.
Under this new regulation, The US Customs request importers to file 10 data elements 24-hour before the cargo loaded on the vessel at origin country. Although the effective date is January 26th, 2009, we have 12-month trial period until the full implementation date, which might be January 26, 2010. During this 12-month period, no liquidated damages assessed for not meeting the nee requirements, or no “do not load” (DNL) holds for compliance issues.
Nippon Express USA Inc is now establishing system connection to file both ISF 5 and ISF 10 to comply with this new regulation. In the near future, we will request necessary information due to this new regulation. We appreciate your understanding and cooperation regarding to this issue.

Importer Security Filling 10


The Importer Security Filing data must be transmitted to US Customs electronically.
1. ISF-5 & ISF-10
  a)ISF-10 for regular shipment (3461, IT, FTZ)
  b)ISF-5 for “Transit” shipment (FROB, IE and T&E)

ISF-10
1)SELLER NAME AND ADDRESS 24 hours prior to lading
2)BUYER NAME AND ADDRESS
3)IMPORTER OF RECORD NUMBER / FTZ APPLICANT IDENTIFICATION NUMBER 24 hours prior to lading.
The amendment process is available, but no later than 24 hours prior to U.S. arrival.
4)CONSIGNEE NUMBER
5)SHIP TO PARTY
6)MANUFACTURER (or SUPPLIER) NAME AND ADDRESS
7)COUNTRY OF ORIGIN
8)COMMODITY HTSUS NUMBER
9)CONTAINER STUFFING LOCATION ASAP. But no later than 24 hours prior to Arrival
10)CONSOLIDATOR
ISF-5
1)BOOKING PARTY FROB:Anytime prior to lading
IE,T&E:24 hours prior to lading
2)FOREIGN PORT UNLOADING
3)PLACE OF DELIVERY

2.10+2 Data and AMS manifest data will be linked with NVO=H-B/L#、or Carrier’s Straight B/L
3.10+2 Data filing is responsible to Importer.
  a)As for FROB shipments, the ISF flier will be carriers, since there is no importer in the U.S.
  b)Other than FROB shipments, the ISF importer or designated authorized agent will file ISF on the ISF Importer’s behalf.(If an agent is used for ISF purposes, a power of attorney (POA) is required.)

Carrier
Carrier must repot Stow Plans and Container Status Messages

It would be difficult to transmit all 10 items from one party, either shipper or consignee, therefore please make arrangement between both origin and destination parties how to collect and send the information in advance.

Frailer to file the information is a violation, along with AMS 24-hour rule, and leads to no-loading shipment on the vessel or the assessment of penalty by US Customs in the future.
