Q. What is the Extraordinary Performance of Customs Clearance (EPCS)?

A.
•Definition
This is referred to as a process of rapidly handling customs-related tasks including the procedures for export and import customs clearance, in-bond transportation procedures, and entry-departure procedures by making the officers work off duty (holidays or duty-off hours) in the case in which it is urgently necessary to perform such procedures as customs clearance, in-bond transportation, shipping and cargo-working.

•Application Procedure
When cargos arrive on weekends or holidays, you need to ask for the EPCS. In this case, you should submit a report that includes the reason for asking for it, the time and others, and shipping documents on the imported articles in question to your customs broker to inform about import before the ship arrives at the seaport, with tariffs and VAT paid. If the customs house does not tell anything about the inspection, it means that the procedure is successfully approved and you can get your cargos faster than usually.

•Expense
Using the service of EPCS would cost you some fees, which include fees to a customs house and fees to a customs broker who performs it in your place. The fees are different from time to time: from 6:00 AM to 6:00 PM; from 6:00 PM to 10:00 PM; 10:00 PM to 6:00 AM next day.

About 60 individual laws including the tariff law, the food hygienic law, and the food sanitation law regulate on how to import and export. These requirements ask you to have a lot of expertise.
The remarkable requirements for the procedures for import and export are as follows:
Food inspection: Korea Food & Drug Administration
Food quarantine: National Plant Quarantine Service
Report about a plan for customs clearance of cosmetics and drugs: Korea Pharmaceutical Traders Association
Safety inspection: Korea Conformity Laboratories Korea Testing and Research Institute for Chemical Industry

Q. Is it necessary to submit a certificate of indication of origin when exported articles are reported?

A. Although a certificate of indication of origin is not a requirement for an import report, the following cases need it:
Intended to have concession tariffs, tantamount to the regulations and agreements of the Tariff Law, applied (Certificate of origin for preference)
A certificate of place of origin for preference should indicate the standards for decision on the place of origin of domestic articles subject to preferential duties and articles that meet the standards.
Articles whose origins should be identified by such regulations as anti-dumping duties, compensation duties, retaliatory duties, emergency duties, and so on (Common certificate of origin)
When a director of a customs house requires a work of repairing the indication of origin to be carried out because of lack of the indication of origin (Common certificate of origin) The certificate should be written in Korean or English.
The certificate of origin can be replaced by its copy that shows that an owner of imported articles knows “if it is different from its original version, the owner is likely to be punished pursuant to related laws”.
The certificate of origin can be usable only for the same B/L. But, if for inevitable reasons—lack of a ship’s space—articles are dividedly shipped, it can be divided for use.

Q. What are the articles that are subject to the system of “indication of origin”?

A. The articles that are subject to the system of indication of origin, as ones directly purchased by ordinary consumers, include imported articles and their accessories (reusable packing materials, dividedly sellable accessories or parts) that are allowed by [Appendix 6-1 of Trade Management Regulations].
